TERMS AND CONDITIONS 


1. Service terms

1.1. All prices in the online store are final (full) on the day of placing the order and include value added tax (VAT). All prices are in euros (EUR).

1.2. All goods will be delivered to you using your chosen delivery method – delivery by Latvian Mail (Latvijas Pasts) or DPD parcel services. 

1.3. The order purchase agreement shall be stored in the company SIA “BSMS” and you can receive it by sending us a request to our address: SIA "BSMS", Delu iela 4, Riga, LV-1004, Latvia, or by sending an e-mail to info@bepersonal.eu 

1.4. Once you have placed your order, you will receive a confirmation in your e-mail with information about the order you have placed.

1.5. If you want to return the product (unless it is personalized), you can do so within 14 days of receipt (postal stamp). In order to receive your money back, you must send the product back by post – undamaged and in the original packaging within 14 days (postal stamp) from the moment of receipt of the product. Money for the product shall be returned to you. 


2. Delivery information

2.1. The goods you order in our online store shall be delivered to you using your chosen delivery method. The delivery costs are to be paid additionally. The full delivery costs are shown in the shopping cart. If you make changes to your order by phone, the operator will inform you about the total cost of the confirmed order.

2.2. Delivery time depends on the product and type of payment.

2.3. If for any reason the delivery time of the product may be delayed longer than the maximum delivery time (30 days), the company SIA “BSMS” will contact the customer personally to agree on the extension of the delivery time or cancellation of the order, refunding the prepayment to the customer.

2.4. You have the opportunity to choose the most suitable way of delivery of goods:

Mail – delivery at the post office:

Your order is delivered using services provided by the services of Latvian Post (Latvijas Pasts). It is delivered to the post office specified in the order. You will receive an invitation from Latvijas Pasts in your mailbox. Only the specified addressee (recipient) can pick up the item in person at the post office, an identity document must be presented, therefore another person will not be able to receive the parcel on your behalf. As for the opening hours, please verify them at the nearest post office.

2.5. Delivery is made in the territory of Latvia and abroad. 

2.6. Delivery costs depend on both the weight of the shipment and the distance to which the goods must be delivered.

2.7. The customer can pay for the goods and delivery costs by online payment (payment on the internet). 


REFUSAL RIGHTS


1. Refusal rights in case of a personalized product: 


1.1. A personalized product is a product to which a unique QR code, design or textual printing elements are added, at the request and/or submission of the customer.

1.2. In accordance with Paragraph 22 of Cabinet of Ministers [Ministru kabinets] Regulation No. 255 of May 20, 2014 “Regulations on Distance Contracts” ("Noteikumi par distances līgumu"), the consumer may not exercise the right of withdrawal in the following cases:

22.1. the provision of the service, which was started before the expiry of the right of withdrawal, has been fully completed, if the consumer has expressly agreed and stated that he/she will lose his/her right of withdrawal from the day on which the contract for the provision of the service is fully performed; 22.2. the price of the good or service depends on financial market fluctuations which cannot be controlled by the seller or service provider and which may occur during execution of the right of withdrawal; 22.3. the product is made according to the consumer's instructions or the product is clearly personalized; 22.6. the product is irretrievably mixed with other things after delivery due to its properties; 22.9. the consumer has opened the packaging of the audio or video recording or computer program; 22.13. a contract has been concluded for the supply of digital content which is not supplied on a durable medium, if the supply of digital content has begun with the consumer's prior express consent and proof of loss of the right of withdrawal.” 

2. Refusal rights in case of a non-personalized product: 

2.1. A non-personalized product is a product to which a unique QR code, design or textual printing elements are not added, at the request and/or submission of the customer.

2.2. The Customer has the right to withdraw from this agreement within 14 days without giving a reason for doing so.

2.3. The right of withdrawal will expire after 14 days from the date on which you, or a third party other than the carrier, specified by you, have acquired possession of the goods.

2.4. The product must not have been actually used, you can try the product out only to the extent necessary to get acquainted with its technical properties, nature and operation.

2.5. To exercise your right of withdrawal, you must provide us with an explicit notice (such as a letter or e-mail), by using the following contact data – company SIA "BSMS", comp. reg. No. LV40003471367, legal address: Riga, Delu iela 4, ph. +371 26478686, e-mail: info@bepersonal.eu, in which information shall be given on the decision to withdrawn from the agreement. You can use the attached sample opt-out form, but it is not mandatory. If you send the product together with the notice of exercise of the right of withdrawal, the product and the withdrawal must be sent to the following address: Company SIA "BSMS", Riga, Delu iela 4, LV-1004, Latvia.

2.6. In order for the right of withdrawal to be complied with, it is sufficient that you send your notice of exercise of the right of withdrawal before the expiry of the right of withdrawal.

2.7. The right of withdrawal does not apply to legal persons, because the regulations of the Consumer Protection Law [Patērētāju tiesību aizsardzības likums/PTAL] and the Cabinet of Ministers [Ministru kabinets] regulations on distance contracts stipulate that these regulatory enactments apply to consumers – natural persons.

2.8. If you withdraw from this Agreement, we will refund to you all payments received from you without undue delay and in any event no later than 14 days from the date we were notified of your decision to withdraw from this Agreement. Refunds will be made using the same means of payment you used for the original transaction, unless you have expressly agreed to do otherwise. In any case, you will not be charged for such a refund.

2.9. We may withhold a refund until we have received the goods back, or until you have provided confirmation that the goods have been sent to the company SIA "BSMS", together with a notice of the exercise of the right of withdrawal. This way you will save your time and get back the money paid for the purchase of the product faster.

2.10. You must return or transfer the goods back to us without undue delay and in any case no later than 14 days from the date you notified us of your decision to withdraw from this contract. The deadline will be met if you return the goods before the 14-day deadline.

2.11. If you return the product, the cost of returning the product must be borne by the customer. The company SIA "BSMS" shall not cover the costs of returning the goods.
